AP/H1B help needed

Hello,

 

Please advise me on the following situation.

 

I am currently in the US in OPT status. My I485 application is pending, but AP/EAD combo card has been approved. My H1B petition has also been approved with a COS (with the start date of October 1st, 2013).

 

Now, I want to travel outside of the US for 2 weeks in July/August. What will happen? I have 2 lawyers who gave different answers.

 

1) My OPT status will be invalidated, and I can switch to EAD. I can switch to H1B status on October 1st.

 

2) Both OPT and H1B will be invalidated.

 

Which one is correct?
