H4 extension denied , what are the other options

My H4 is valid till July 31 2013. H1 starts from Oct 1 2013.
So I have applied for H4 extension Aug 1st to Sep 30, which got denied saying already I129 filed for this persion do not need to file I539 (H4 extension form) .
Is H4 extension can be re-applied??
So I am checking what I can do to stay here for these 2 months 

I dont want to go India for H1 stamping , it involves lot of risk 

Please advise what I can do in this situation .

But what's the use?? It's been already rejected for a genuine reason. I guess you have to cross the border and enter with H1.
