uk2013 Posted July 1, 2013 Report Posted July 1, 2013 A friend of mine (B1 holder) will be traveling to US for a year with his wife who got a visiting researcher position in a college on J1 visa. He already has a 10-year multiple entry B1 visa. Can he enter with his B1 and stay here for a year while his wife stays on J1 visa? Or should he need to get a J2? Thanks,
Attorney_11 Posted July 1, 2013 Report Posted July 1, 2013 Generally, an individual may be admitted for up to a year in B classification for certain purposes. However, in most cases, the initial period of admission is six months which is extendable. A J-2 derivative classification may make remaining in the United States for the duration of the J-1's authorized stay easier, but note that if the principal J-1 is subject to the home residency requirement, the derivative J-2 is similarly subject until the principle either waives or fulfills the home residency requirement. Each situation is unique. It is advisable to speak with a qualified immigration attorney to determine a personalized case strategy.
uk2013 Posted July 1, 2013 Author Report Posted July 1, 2013 Thanks for the answer. He certainly doesn't want to switch to J-2 due to its home residency requirements. Could he (B1 holder) leave the country for a few weeks after the initial 6-months to trigger a second 6-months stay? Or would it be easier to apply for an extension while here.
