H1 transfer issue

Hi All

 

 Right now am working for  company A and accepted an offer from company B. Right now company B is performing background check through third party and I filled the forms for background check. I mentioned clearly in the forms not to contact my current employer and despite that they contacted my current employer even though my H1 transfer is not yet initiated. Now my company A employer wants to know what is happening. As of now am worried about my current status if something goes wrong.

 

What are the options for me as I specifically mentioned in the forms not to contact my current employer. Should I sue the background check company if I lose my current status.  I already let Company B know about this situation. What is the worst case scenario that I can encounter and what would be the solution.

 

Please experts let me know what to do.

The best option is to have a backup company © ready in case of any issues with Company A/B
