travelafficionado Posted June 24, 2013 Report Posted June 24, 2013 Hi folks....my employer paid FICA taxes (social+medicare) for 6 months during my OPT and I am unable to get them back from tax authorities after filing 843 & 8316 forms. Reason being that I need to file 1040 NR instead of 1040. But if I do that I will lose my tax refund filed as a resident for tax purposes. Please advise how to get the FICA taxes back?
JoeF Posted June 24, 2013 Report Posted June 24, 2013 You would have to file a 1040NR. Only students on F1 who file a non-resident return don't have to pay the FICA taxes.
