travelafficionado Posted June 24, 2013 Report Share Posted June 24, 2013 Hi folks....my employer paid FICA taxes (social+medicare) for 6 months during my OPT and I am unable to get them back from tax authorities after filing 843 & 8316 forms. Reason being that I need to file 1040 NR instead of 1040. But if I do that I will lose my tax refund filed as a resident for tax purposes. Please advise how to get the FICA taxes back? JoeF Posted June 24, 2013 Report Share Posted June 24, 2013 You would have to file a 1040NR. Only students on F1 who file a non-resident return don't have to pay the FICA taxes. Link to comment

FICA taxes should not be deducted by employers in the first place! Any suggestions other than 1040NR? Link to comment
