keshav79
Hello Everyone My current employer has filed GC in EB3 category in year 2009 and I140 is already approved. I have completed 9 years on H1B already and now on 3 years extension period as i already have I140. My questions: 1. Can I switch job and transfer H1B Visa and file GC in EB2 category with new employer? 2. Can i keep old priority dates that i received on my GC processing under EB3. 3. Does anyone have experience in this and share any problems you faced and any precautions i need to take? Thanks for your time Keshav Link to comment
omshiv
Everything is possible..provided the new job desc requires a EB2 candidate...do this thru an Attorney. Link to comment
t75
It is easier as a new employee than with the same company. Link to comment
keshav79
Thanks for your responses. @t75: May I ask why it would be difficult to get it done with same employer. I was also trying to explore this option by switching organization as i recently got promoted. Thanks again. Link to comment
t75
The new job has to be significantly different from the old and experience gained at the same company does not count. Link to comment
