H1 - Industy to Academia to Industry

Hello Forum:

 

I got a question about my H1 transfer - my first H1 is in industry, going through standard process (Cap, Oct 1) - I then moved to H1 in academia (University) after working for few years. I would now like to move back to industry (for profit) to a new company - can the new company transfer my H1 immediately knowing I have got my industry H1 first and that I am cap-exempt because of it or will I fall under "Academia to Industry" because of my current job in University where they need to start my H1 all over again and I have to wait till Oct 2014 to start the job? Your answers/guidance welcome.
