nineballs
I think USCIS advises to apply 2 months in advance for I-94 extension. But, you are ok, even if you apply on the last day of I-94 expiration. In my opinion, if possible, go out of the country and enter back on L-2 visa and you should get a new I-94. With that, you can get an EAD for the new duration. If thats not possible, you can apply for I-94 extension maximum 6 months in advance. so, you may only apply for your I-94 extension in Jan 2014 at the earliest and Jun 2014 at the latest.
