gchoubis
Hi, I'm on L1 B and I'm going for L1 B Visa extension stamping to Canada on 17th June, because I want to go to India in July for some personal reasons. I have also applied for H1 B (L1 to H1) through another employer and the petition is under processing/unapproved yet. Please let me know whether the fact that I'm going out of country, when my H1 is under processing , can cause any issue for my H1 approval. Link to comment
pontevecchio
The H1 will be approved on merits. The COS will be denied. Hence you would need the H1 visa. Link to comment
gchoubis
Can I apply for COS again after I have come back? Link to comment
pontevecchio
Will the employer spend double as he has to file another H1 petition with COS? If he is more scared about getting a H1 visa maybe he will spend double. Ask him. Link to comment
gchoubis
so..it is possible to get H1B after I come back..right?..if employer pays for COS?...any idea how much does that cost? Link to comment
gchoubis
any replies to the above query? Link to comment
pontevecchio
Nothing called COS by itself for H1 status. The employer has to refile and get a H1 petition with COS approved before you can work. Link to comment
