Supreet
Hi, I got my H1B stamped last year but couldn't travel for some reason. I am not sure if the company which originally sponsored my VISA has filed for a cancellation or not (haven't received any notification and not sure if it is possible). If a new employer is willing to hire me do they have to file a new petition or a VISA transfer application would do ? And in case its a new application, will the quota limit still apply and do I have to get stamping again ? Thanks a lot got your help! Supreet Link to comment
rahul412
Your new petition will be cap exempt and if your old H1 visa is still valid then you don't need a new VISA. Link to comment
ge145
Please contact the company who filed for your old visa If they have cancelled, ask them for the cancellation notification. Companies receive those notifications from USCIS (mandatory). Yes for new employer to get a new petition for you. Yes for stamping as well Not sure about quota - please consult an attorney Link to comment

H1 sponsoring company can revoke the petition, but cannot cancel the VISA. Link to comment
