J1 to H4 without waiver

I was working as a postdoc in J1. Due to severe illness I had to quit and come back to India. Can I get H4 without J1 waiver? If so, after going to US as H4 can I switch to H1B when I receive my J1 waiver. I have the No Objection Letters ready but not sure how to apply from India for the waiver. Any input/recent experience will be really helpful. Thanks.
