SM1
Dear Forum Members, I am on a H1B. My understanding is if my employment is terminated, I am out of status the next day. I interpret this to mean that I am legally required to exit the country on or before the last day of my employment. Is this a correct interpretation? I would like to read the specific law addressing the above rule for myself. Could someone point me to the the specific law/act reference that addresses the above? I would be most grateful. Many thanks for your time and effort on this. Link to comment
omshiv
Your understanding is correct. Once your H1B ceases to exist you no longer are in any Legal Status (unless you have a pending I-485)...thats the reason you'll have to exit the country immediately to avoid being Out of Status... Note that OoS is different from Illegally present. Link to comment
JoeF
The immigration law is online, e.g., at the USCIS website. There also is a USCIS memo stating this explicitly. And every lawyer knows it, see, e.g., http://www.murthy.com/2012/11/26/h1b-layoff-strategy-when-changing-h1b-employer-2/ Link to comment
