H4 to H1b transfer with RFE - Urgent

Hi,

I had a valid work visa with which i never travelled to US. The validity is till Nov 2014.

I travelled to US in H4 visa in April 2013. I got an offer with a client and so my employer H4 to H1B amendment was filed in premium processing mode last week. Yesterday I got an RFE asking for client documents and my employer is working on it. Meanwhile my date of joining with the client commences early next week. So can I commence my work (only with the receipt number) with the client while the RFE is still in process? Also what should I do say if the H1B petition is rejected?

Kindly let me know your advice on this.

While your H1 is processing, your current status will be H4. And on H4 you cannot work.

You must wait for approval and I-94 with H-1B status.

If it is rejected, you may not work.
