When I was working with the non-profit organization, my wife visited India and got her H4 stamped (stamp valid until 2014). Now, I work for a profit-organization company and have approved H1-B and H4 from last year (petition approval until 2015). My concern is do we have to get the H4 stamp again for her if she visits India this summer? As her H4-stamp is still valid, I hope this should not be a problem while entering back to U.S. We just need the new H4 approval petition. Any suggestions would be really helpful. Thank you. Vipul
rangadu Posted May 10, 2013 Report Posted May 10, 2013 It should not matter as long as you have a valid H4 Visa stamped with a date beyond your date of entry and your new for-profit 797. It is the status that matters, whether it is for-profit or non-profit, shouldn't matter. Long ago, when I switched from a non-profit org to a for profit firm, I used my H1 visa stamped for the non-profit with a 797 from a for-profit company multiple times for entry.
Capri06 Posted May 10, 2013 Report Posted May 10, 2013 You dont need new visa. All it matters is valid H4 visa, and your H1 & H4 approved petition that is valid.
