On H4 and getting back on previous H1b

Hello,

My wife had H1b approved from 2007 till 2010. She was on H1b from 2007 till 2008, after which she moved to H4.

- Can she even now after the H1b quote for 2013 is already over, use the same H1b to start working again?

- If she can use the same H1b, does she have to file for change of status(COS) from H4 to H1b with the same employer or can she file COS through any employer?

her new employer has to file for H1...but shes not under Quota.
