movingforward Posted May 2, 2013 Report Share Posted May 2, 2013 Hi All, Please help me how tough my situation is, I'm anxiously waiting for my 7th year extension. 1. With all the recapture period my H1B is extended till Jan 20' 2014. 2. Filed the perm on Jan 18' 2012. 3. No updates on perm yet, assuming it's in process. 3. It will be exactly 365 days on Jan 18' 2014 that is 2 days before my H1B expiry. My question is, since Jan 19th 2014 is Sunday and and Jan 20th 2014 is my last date on my H1B, how safe it is to file the extension on the last day of my H1B visa expiry? Is it advisable? I'm planning on a worst case scenario provided no update on perm for next 8 months. Thank everyone in advance! Link to comment

omshiv Posted May 2, 2013 Report Share Posted May 2, 2013 ok...anways assuming your Labor gets cleared in another 1-2 months...apply I-140 under PP..whether its in Pending status or Approved before your H1B expiry....you may always get an extension based on the Pending/Approved status.
