EB3 to EB2: I-140 approved but the PD is not ported

Hi

My EB3 PD is May 2010 and my EB2 date is June 2012. My EB3 PD is not ported and my attorney is saying that depends on the Case Officer. Can we appeal again in this scenario? Please suugest. Both EB3 and EB2 are applied by the same employer and the same centre.
