googler Posted April 25, 2013 Report Posted April 25, 2013 Dear All, Currently on L1 with company A. Company B wants to hire me and apply for H1B but quota exceeded as I read on USCIS website for FY2014. Is there ANY way I can get employed with company B? Is there anything they can do to het me a visa so I can work for them? They are even ready to apply for my Green Card, would that help if 1. and 2. are "no"? Can you suggest any approach in this case? Thank you!
t75 Posted April 25, 2013 Report Posted April 25, 2013 No. GC application will not make you not subject to quota. They can apply in April 2014
googler Posted April 25, 2013 Author Report Posted April 25, 2013 Can they apply directly for a GC (and not for H1B)?
sk.january Posted April 26, 2013 Report Posted April 26, 2013 GC is for future employment and you don't have to be currently employed on an H1B for company-B to start GC processing for you. You still need an H1 to work for them.
