beetj1 Posted April 25, 2013 Report Share Posted April 25, 2013 In the following scenario - If a person is on OPT status which expires in November applied for H1B Visa has a job offer a non-profit organization. Can the new H1B filed after getting an approval for the original petition and can he/she join the new company after the new petition is filed before Oct 1st since OPT does not expire? Link to comment
t75 Posted April 25, 2013 Report Share Posted April 25, 2013 Not all on-profits are cap exempt. OPT continues as approved H-1B will have a start date of Oct 1 or later. Person can change employers on OPT; be sure to notify DSO. Link to comment
