Would USCIS still process H1B after applying to school for master's?

Hi Friends,

I am currently on OPT and my employer applied my H1B for the year FY 2014. Since then i don't have any update on my H1B visa status. Also my OPT expires this July. To maintain my visa status i want to apply to school for master's.

1. Say if my H1B gets picked up in lottery after i applied for school would USCIS still process my H1B or hold it because i applied for school?

if you simply join a school to be in status, it will create more problems.

Once your petition is selected upgrade it to PP. And if you are not eligible for OPT ext then you have to leave the country.

Talk to your DSO about your eligibility for cap-gap.

No uscis will not hold your H1b petition , if you join new college .

Forgot to mention about cap-gap. Your school DSO will explain you about the cap-gap, ask them and find out whether you are eligible or not.

Thanks for your information. I spoke to my International Student Officer and they replied back saying i will be eligible for CAP-GAP only after i have my H1 picked up.
