ahin2012 Posted April 22, 2013 Report Share Posted April 22, 2013 Can we get H1B extension even If previous employer revoked I-140 Here are my details, Gurus please advise. 1) Filed 485 in July 2007 and maintaining H1B status also 2) Changed Employer in May 2010 and filed AC21 and also got 3 years H1B extension in new company based on previously approved I 140 (with old employer) (now I am on 11th year on H1) 3) Since then no issues and getting EAD/AP approvals also. No change in I 140 status in USCIS website also. 4) Not sure whether my previous employer revoke 140 or not, they mentioned they will revoke it and i am sure they don't keep it 5) Now my H1B is expiring in month and need to apply for extension based on previous employer I 140 only My questions are 1) Since I don't know the status of I 140, can I apply H1B extension? 2) If 140 is revoked by previous employer, do I get H1B extension or they reject my H1B file? I am having EAD also and planning to switch to EAD, but want to maintain H1B status if I can get extension. Sorry for long post, Please advise. Thanks in advance Link to comment
