skol Posted April 20, 2013 Report Share Posted April 20, 2013 I started working in the US in July 2007 and my H1B 6 years max out is in July 2013. Now my employer is willing to apply for L1A as I have managerial experience both in India and US. But I am a little confused as to whether I should apply for change of status from H1B to L1A(individual) while in US or go back to India and apply for L1 A blanket, get it stamped and return to US. Can anyone please tell me the pros and cons of both options? My employer is saying that change of status to L1A while in US with only 3 months left on H1 is riskier as there is more chance of rejection than applying for L1 A blanket from India. Is this true? Any idea about the rate of rejections for change of status from H1 B to L1 A with such a close H1B max out date? Note: My GC processing has not started yet. Link to comment
