H1B Extension is in Process for 11.5 Months

Hello,

Can someone tell me an idea on my case.

My Visa and H1B expired in Apr 2012.

I have applied my H1B Extension in Apr 2012 on the day before the expiry date.

Got RFE in Oct 2013 for employee - employer relationship and replied with all the questions asked in RFE.

Responded to RFE in Dec 2012.

Until now my status shows RFE response Review.

I heard from my employer they holded 30 cases(working for my employer) and doing security check, USCIS is returning back the fee if we upgrade for premium.

My I- 94 is expired in May 2012. can i stay legally in this country if the H1B is not approved and extension is on process for more than 6 months.

I also have approved I-140 with this employer.

Apart from this i have to extend my drivers license which is expiring next month, is there a possibility i can show the H1 Receipt and extend my driver license???

Please let me know your valuable thoughts and share any one came thorugh this experience.
