H1B visa transfer denied

Hi All,

Looking forward for your valuable suggestions.

My visa H1B visa transfer was initiated in Nov, 2012.

After that we got couple of RFEs to show the employer employee relationship.

My employer is responding to the 2nd RFE now.

in the worst case, if my petition gets denied what are my options?

My wife is on H1B visa and working for a different client.

1. If I change my status to H4 now and if I get any project with in 1 or 2 months what are the possibilities for changing my status back to H1?

2. when a new employer files a new H1 for me, will it come under H1B cap? should wait till next cap?

3. If I get a new H1, should I go back to india and get stamped?
