My H1 B starts from oct but OPT ends in June

Hi ,

I am Currently on OPT Extension and my opt expires on 'June 15th 2013' and i applied for H1B if it approves it will start from 'OCT 1st 2013' but there is like More then 3 months gap between by OPT ending and H1 Starting ,so what should i do now please let me know.

If i apply for Cap-Gap it will be only for 60 days.

Cap-gap would allow you to work until the H1 kicks in.

I think you have to come out of USA and if your H1b is approved re-enter USA with valid visa on it . OR you can convert F1 to B1 during the period and be in US.

You will come under cap-gap, as your OPT extension expires in June 2013, so your cap-gap will be there until september 30th, so you are good, also check your school DSO.

As i understand, you will be covered by CAP-GAP if your H1b get selected. And also after/during H1b approval, you can apply for "Change of Status". If H1B & Change of Status are approved you won't need to leave the country in order to use H1B after October (you will get new I-94 on Change of Status).
