Now I want to go back to USA and planning to contact previous employer (previous H1B employer). Is it possible to file H1B transfer based on old petition if I didn't completed 3 years ? If INS will treat mine as new case then I've to wait for next year cap but if its possible to file/extend/transfer based on previous petition filed in 2006 (stayed in USA from 2007-Feb'2009). Please help me if you have experienced the same. Link to comment
0407 Posted April 11, 2013 Report Share Posted April 11, 2013 you are eligible for 4 more years on previous H1B. Either the previous employer or a new employer can file for H1B based on old approved H1B based on which you had worked for two years Link to comment
