vinayrd
Hi, I am working at a university on STEM OPT. My OPT expires in July, 2013. My university is in the process of filing for cap-exempt H1-B. If I receive a receipt number from USCIS, say in June and the actual decision happens in August, will I be eligible to work between July (after my STEM OPT expires) to August (when USICS makes a decision) Since mine is a cap-exempt application, I am know sure if it would fall under the "cap-gap" purview. Any suggestion is greatly appreciated. Thanks, Vinay. Link to comment
Attorney_22
Unfortunately, no. Thus, it may be advisable to file the H1B petition pursuant to premium processing. If you have additional questions, please schedule a consult with one of our attorneys. Link to comment
