drramki Posted April 9, 2013 Report Posted April 9, 2013 Hi, I was in J1 from 2008-2011 with 2 year HRR and then went out to work in another country. Now I am back in US with a short-term J1 (2 year HRR) and I am looking to apply for a J1 waiver. Should I submit two separate applications for the two J1s or should I update my old application with new J1 and submit one application? Anybody with similar experience? Thanks.
Attorney_11 Posted April 9, 2013 Report Posted April 9, 2013 In most cases, a single waiver should satisfy waiver of a home residency requirement. There is no requirement that an individual waiver be filed and approved for each program that an exchange visitor participated in which rendered an individual subject to the home residency requirement. Some limitations may apply based on individual circumstances, so it is recommended that a qualified competent immigration attorney be consulted for personalized advice.
