baghya143 Posted April 8, 2013 Report Share Posted April 8, 2013 Hi, I was here on L1 - B till DEC 6th 2012 from Oct 2007 My company applied for a change of status to H1B, which i got on Dec 6th 2012 as part of H1B 2012 quota. If I calculate my 6 year term with L1b+ H1, the 6 year period is completing on Jan 2014(excluding the days stated outside the country on vacation). But USCIS gave me an approval for my New H1B till Dec 2014, which is till end of seventh year. My labour will be filed on June 2013. If i don't get my I-140 till Jan 2014, can I stay beyond Jan 2014. So that I will have buffer time to get my I-140 approval. Link to comment
JoeF Posted April 9, 2013 Report Share Posted April 9, 2013 USCIS made a mistake. They will eventually find out and fix the H1 end date. Do not try to benefit from their mistake. If you stay longer than the 6 years, you may find yourself illegal retroactively when the fix their mistake. Link to comment
