handin Posted April 8, 2013 Report Share Posted April 8, 2013 Hello! Thanks for looking into my case!! My H1B petition approved on June 2005. I stayed in US on H1B from May 2006 to June 2007. Stay is US on H1 Status --> 1 yr 2 months I stayed In India from July 2007 till March 2010. I obtained L1A visa and traveled to US on April 2010 and in L1A status till now. Stay is US now on L1 status --> 3 years If an employer wants to apply H1B for me, can they apply under cap exempt anytime this year? Since I have not used all 6 years of my H1 status. Thanks!! JoeF Posted April 9, 2013 Report Share Posted April 9, 2013 The time on H1 and L1 is counted together. If that time is less than 6 years, you can get an H1 at any time for the remainder. Link to comment
