Sunbabu Posted April 6, 2013 Report Share Posted April 6, 2013 My brother had H1B Twice: First H1B approved from 2005-2008 but he stayed only for 6 months in USA and then second H1B approved from 2007-2010 and travelled to USA during 2008 and stayed in USA for about 9 months and came back to India.So now my question is,if he wants to have H1B filing, will that filing be H1B Cap Exemption because he stayed in USA in H1b Status for about 15 months(6+9) and was out of USA for more than a year so i am thinking his H1b Status period of 6 years was not completed yet.Please help me clarifying or confirming this.
