JobHuntt Posted April 2, 2013 Report Share Posted April 2, 2013 Currently on H4 but I have a previosuly approved H1B petition(expired on July 2012) from one of my ex-employer but I have never travelled to US on H1 before or availed that petition. I have this petition number but do not have the petition papers as my ex-employer had misplaced it. I have an official email from my ex-employer which says that it belongs to me. With this information can I file for my H1B under cap exempt quota & start working immediately? Awaiting a reply at the earliest, Link to comment
0407 Posted April 4, 2013 Report Share Posted April 4, 2013 you can if some employer is willing to believe that petition was filed for you. I have known cases where transfer was done based on just the receipt notice number. You need good attorney and some employer who is willing. Link to comment
