Duplicate copy of I-797

Hi,

I had a H1B in 2008 which is expired now. I havent travelled using that H1B at all.

Now Iam in US on H4 visa. I would like to apply for H1B under the earlier quota. For that i dont have a copy of I-797(Notice of Action). I only have my H1B receipt number.

Is it possible to file a H1B( not subject to this year's quota) with that receipt number?

If not, when i apply for a duplicate copy of I-797 from USCIS, will it reach me or my previous employer( who actually filed the H1B for me)?I am no more associated with that employer. So they are not willing to give me a copy of I-797. Please let me know.

Yes, with receipt number it will be fine.
