In the year 2010 I got my H1B petition approved by Employer B which is currently valid until Aug 2013. As my current employer A cannot file for L1B extension to due many rejections he wants to process my H1B under Cap exemption using the same approved petition of Employer B & later file for H1B extension.I do not have the H1B approved petition from Employer B all I have is the H1B Filing receipt number from Employer B. Can you help me as how can I get a copy of my approved H1B Petition of Employer B for processing? Thanks RK Link to comment
0407 Posted April 2, 2013 Report Share Posted April 2, 2013 Employer has a choice not to give it to you. If your H1B got approved with Change of status (COS) and you are still continuing with your current employer you are out of status. This is assuming that you didn't leave the country and enter to get a new L1B I-94 . Transfer on receipt number alone is possible. You need a good attorney for the same. Have at least receipt notice is better. Use your negotiation skills to get the H1B approval copy Link to comment
