aj2013 Posted March 30, 2013 Report Posted March 30, 2013 Hi My Case: - I am a full-time employee of a staffing company A, and work at client location say company B (contracting for client). - I am completing my 6th year of h1b in Aug 2013 - My PERM and GC was filed under company A and I-140 is approved with early 2011 as PD Questions: - I can apply for H1b extension right now, but could i get extension for 3 years or it depends on the client project timeline ? e.g. if the current client company B says my project lasts until Dec 2013. If i apply h1b extension, i get only 4 months extension (from Aug-13 to Dec-13 ?) Or client project timeline is completely irrelevant since my I-140 is approved and will 100% get 3 years of h1b extension ? Thanks
kalyan_ac Posted April 2, 2013 Report Posted April 2, 2013 Since you are in the consulting model, you will still need to show the client letter etc and you will be given the extension based on the client letter etc but not the approved I140.
