f1studenthere Posted March 28, 2013 Report Posted March 28, 2013 I have been in the US for more than 5 years. My first question is whether I need to file form 8843 at all. Last year, I put "no" in line 12 because I wasn't in the country for more than 5 years, but now I am, and I would like to know whether I must file form 8843 once again even though I have been here more than 5 years. The total number of times I have filed form 8843 (not including for 2012) is 3: One for 2009, one for 2010 and one for 2011. I should have but did not file those for 2007 or 2008. Second question is: if I do need to file it, then I need to say "yes" on line 12. If I answer yes, I need to provide an attached statement providing sufficient facts that I do not intend to permanently reside in the US. Or what exactly are they looking for when they say they want sufficient facts? Is there a sample statement I could look at? Thanks for any help in advance!
