dwarak_cit Posted March 27, 2013 Report Posted March 27, 2013 Hi, I have H1B visa valid from Oct 2010 to Sep 2013. When i applied & went for my H1B visa stamping, I had my LCA approved for NEW YORK. But instead i travelled to CHICAGO using a revised LCA for PITTSBURGH during 2011. I also returned back on the same year and planning to travel in April 2013 but this time to NEW YORK. Question # 1: What is the salary that my employer needs to pay me as per law? Is it the prevailing wage in 2012-2013 year or the salary mentioned in the NEW YORK LCA? Question # 2: Since i changed my LCA to CHICAGO's would that mean my 2010's NEW YORK LCA is not valid and that I need to again apply for a new LCA? Because the prevailing wage and LCA wages are different and would like to know which WAGE would be considered. I read in some forums that LCA wage supersedes. But as such is my NY LCA still valid? Any help here is much appreciated.
