Applying H1B while H4 extension is just applied/in process

First of all, thanks to MurthyForum for such wonderful suggestions.

I am here in US on H4 along with my husband who is on H1.

Both of our Visas are getting expired on 4th April 2013. My husband's company applied for extension of his H1 and my H4 just two days back(i.e on 25th Apr 2013). I found an employer who is ready to file H1 B on April 1st 2013 based on my old I94(which is also valid till 4th Apr 2013).

Shall I take risk of applying H1?

What are the chances of getting H1? What are the chances of RFE?

Please advise.
