Attorney_25
An I-140 approved with a prior employer can be used for a 3-year H-1B extension with a new employer as long as it has not been withdrawn/revoked and as long as the priority date is not current. Link to comment
laskan2k
Thanks. Could you please let me know if a cap exempted H-1B petition is possible? As i understand that I-140 can be withdrawn/revoked only if the employee has committed any fraud. Am i right? Is there anyway an employer can withdraw/revoke I-140? What if I-140 is revoked/withdrawn without the employee committing any fraud? Thanks Again Link to comment
