narendrareddyg Posted March 24, 2013 Report Share Posted March 24, 2013 I am holding H4 visa and residing in India. Planned to travel to US on H4 and apply for H1B visa from here in April 2013 quota. But now i am sick and doctor suggested to reschedule travel plan. Now the question is: Can I file H1B petition residing in India and then travel on H4 to US and change visa status when my petition gets approved living in US? Link to comment

Can my employer apply for H1B from India and then travel to US on H4 (currently I am holding) before petition gets approved.
