narendrareddyg Posted March 24, 2013 Report Posted March 24, 2013 I am holding H4 visa and residing in India. Planned to travel to US on H4 and apply for H1B visa from here in April 2013 quota. But now i am sick and doctor suggested to reschedule travel plan. Now the question is: Can I file H1B petition residing in India and then travel on H4 to US and change visa status when my petition gets approved living in US?
t75 Posted March 25, 2013 Report Posted March 25, 2013 Yes, an employer can file for you even if you are not physically in the US. YOU can not file an H1B petition.

Can my employer apply for H1B from India and then travel to US on H4 (currently I am holding) before petition gets approved. After petition gets approval Can I apply for change of status living in US?
