H1-B Cap Exempt - Time Period

I have an expired H1-B. Below are the details :

H1B Issue Date : 13-Oct-2007

H1B Expiration Date : 18-July-2010

I worked on this H1-B through "Employer A" from Dec-2007 to Jan-2010 (i.e. 2 Years). Then I went back to India for 18 months.

After that i came back to USA in June-2011 on L1-B through the same Employer.

I know that I can apply for H1B now anytime as CAP Excempt as I was on valid H1-B status in last 6 years
