Question on Travel to India before visa expiry also reneval In Process

Hope you doing great !

Here is my question :

My wife is on h1b visa which needs to be renewed by this august 2013(she is all set for this with her employer and her lawyer too), I'm on h4 visa staying with her in USA since July 2011 & my visa valid until Sept 2013. Now we are planning to visit our families in India for 45 days (like may 2013 to July 2013) . Here is my question, is there any problem for me or to my wife while comming back at the port of entry ?

We have a 1 year old son(born in USA, June 2012) who is living in India with our parents, he has a US passport.

Kindly suggest me, this is very important to make a decision on our travel. Also Open to any suggestions.
