Attorney_11 Posted March 21, 2013 Report Share Posted March 21, 2013 In general, the USCIS requires proof of J-1 waiver approval prior to approving an H-1B petition, if applicable. As a courtesy to petitioners and beneficiaries, the USCIS will accept an H-1B petition for filing with proof of DOS recommendation of the waiver and will then work with the relevant USCIS division or service center to adjudicate the J-1 waiver at the Service Center while concurrently adjudicating the H-1B petition.
