I am currently out of US, in my home country due to personal predicament and cannot travel to US before this month end. I also have an approved I140. shandan Posted March 20, 2013 Report Share Posted March 20, 2013 File an extension to your H1B (if the employer still has a genuine job to offer you), if your six year cap is already expried then used the approved I-140 to file for extension, once H1B is extended, get it stamped and come back to US. Now what are my options to come back to US after marriage? Am I better off coming on new H1 or on B1 visa. Also, is B1 easier to get as I was holding a valid H1 till last month.
