GC2018
Hi I got my H1 stamped recently in India but was then laid off by my company while still in India. Since I am in India for 2 months now I do not have the latest pay stubs as well. My question is, can I get my visa transferred while in India if any company is willing to do so? Thanks Link to comment
shandan
Since you never got to US you never were on H1B, so do not worry about pay stubs. But not sure if you can file for H1B COS to another employer when you never worked on that H1B and are not in US, better consult a good immigration attorney, or better yet have the other employer file for a fresh H1 cap exempt. wiweq
H1 transfer is nothing but a cap exempted new H1b. Because you have already counted towards quota, this new H1b will be cap exempted. Find an employer and ask them to file you cap exempted H1b. No need to start your work till Oct 1st. Once H1b approved, you are good to work. Link to comment
GC2018
I was actually in US for more than a year on H1 and was working in EVC mode. Does the above still apply? Link to comment
GC2018
Actually I was in US for over a year on H1 and was employed the entire time but once I was in India and had to extend my vacation, all these issues started. So, can I still transfer H1 visa from India without the pay stubs? Link to comment
