balapitts Posted March 19, 2013 Report Posted March 19, 2013 Hi, I am in H4 and applying for H1B visa this April with the adjustment of status using my current I-94 admission. Planning to go to India in May and coming back in July with my current H4. I will get stamping for current H4. If we go out of US during process of adjustment of status, do they reject H1B. Is it possible for me comeback with my current H4. Please advice in this situation.
0407 Posted March 20, 2013 Report Posted March 20, 2013 H1B won't be rejected. COS will be. Meaning you will get H1B without I-94 and would need to get either a visa stamp or would need to "amend" the H1B to be able to work
