I am currently on OPT STEM ext which expires on July 24th 2013. I will be applying for H1-B through my company's sponsorship this April.However, since there is a need to travel, I am wondering if I can apply for a faster(premium H1-B)application, and then once I get approval, travel to India on OPT visa and return back before July on OPT before it expires,Will this cause any issues at immigration check when I return since I would only have a month for my OPT to expire? Also, I would need cap gap extension after my OPT expires until Oct 1st, so would Immigration ask for cap gap proof along with H1-B proof?Are there any risks with this kind of travel scenario?
wiweq Posted March 20, 2013 Report Posted March 20, 2013 If you visit India after H1b approval with COS and come back to USA with unexpired F1, you don't have any problem.
