incorrect name and incorrect date of birth on birth certificate

I posted in other section but I guess "Birth & Marriage Certificate" section is not read as often so asking it here as it would be related to 485.

I am trying to get birth certificate for my family member but there are the issues:

name on birth certificate is incorrect.

date of birth incorrect.

"certificate of non availability" cannot be issued.

I asked them to provide "certificate of non availability" but they cant do that either. They are supposed to look for 1 year around the date of birth based on your parents name and your gender. If they find any match they have to provide that. There might be another person with different name, date of birth but with same parent name and we are stuck with that. How can we fix it?

You can get the name and date corrected by filing an affidavit in a court of law where you were born. I don't know the exact details of the procedure, but after you file and affidavit, the will issue you a new birth certificate with corrections.

My wife's parents corrected my wife's name in her birth certificate that way.
