sld Posted March 18, 2013 Report Posted March 18, 2013 Hello, I am an Indian national. I worked for my previous employer for 5.5 years. In that time, they filed for LC, I-140 and I-485. My priority date is Dec 2008 and filed for I-485 in Jan 2012. The current state is that my I-485 is pending with the USCIS. I already have EAD/AP card. In Dec 2012, I changed the job using the provision of AC21. I work for new employer on H-1B visa. I got married two months ago. My spouse works on H-1B visa and his own green card application is waiting for I-485 filing stage. I would like to add him to my green card application as the dates get current. I know the visa bulletin dates need to be current for my green card application to be approved and also to file for him. My question is: Are there any considerations with respect to pending I-485, job change, and then adding spouse to the application? Are there any situations when adding spouse to the application may not work? Thank you for your advice!
Belle Posted March 18, 2013 Report Posted March 18, 2013 As long as your I-485 is in good standing and PD is current, your spouse is fine to file as a derivative. Good standing means either pending or approved (in other words, not denied or withdrawn).
