I started looking for other options so that I could return to US as soon as possible. I got a call from one of the consultancy firms and they said they can apply for my h1B visa now so that USCIS will get the new H1B petition in another 15 days. Lets say USCIS gets my H1B petition by April 1st week. My question: Is this possible? Is there a cooling period? Can USCIS get a new H1B petition on the case for which L1B was rejected before 2 - 3 weeks? I wanted to know if its worth to take a risk as I got to pay some lump sum money. t75 Posted March 16, 2013 Report Posted March 16, 2013 Do NOT buy and H1B visa by paying company to file; very few fees are payable by the employee. Even if H1B were to be approved, you cannot enter on it until 10 days before Oct 1 start date. Do not be an idiot and send money to a company who is trying to violate US laws.
